Topic 1: Introduction to Property Law and Concepts

Topic 4: Specific Transfers of Property: Mortgage and Charge

This topic examines Mortgage and Charge, which are transfers of interest in immovable property for securing a loan. It defines 'Mortgage', discusses its different types (simple, mortgage by conditional sale, usufructuary, English, by deposit of title deeds, anomalous), and covers the rights and liabilities of the mortgagor and mortgagee. The concept of 'Charge', which is distinct from mortgage, is also explained.

Topic 5: Specific Transfers of Property: Lease

This topic covers Lease, a transfer of the right to enjoy immovable property for a certain time or in perpetuity, in consideration of a price (rent) paid periodically. It defines 'Lease', explains its essential elements, discusses the rights and liabilities of the lessor and lessee, and covers how a lease can be determined or terminated.

Topic 6: Specific Transfers of Property: Exchange and Gift

This topic focuses on two other modes of property transfer. 'Exchange' is a mutual transfer of the ownership of one thing for the ownership of another, neither thing or both things being money. 'Gift' is a transfer of certain existing movable or immovable property made voluntarily and without consideration, by one person (donor) to another (donee) and accepted by or on behalf of the donee.

Topic 7: Specific Transfers of Property: Actionable Claims

This topic introduces 'Actionable Claims', which are unsecured debts or beneficial interests in movable property not in the possession of the claimant. It covers the definition and characteristics of actionable claims and the rules governing their transfer under the Transfer of Property Act.

Topic 8: Easements and Licenses

This topic deals with rights that are related to but distinct from ownership. 'Easement' is a right which the owner of one land has, as such, for the beneficial enjoyment of another land not his own (e.g., right of way). 'License' is permission to do something on immovable property which would otherwise be unlawful, without creating any interest in the property. The creation, types, and extinction of easements and licenses are discussed.

Topic 9: Lis Pendens and Transfer of Property

This topic covers the doctrine of 'Lis Pendens' (pending suit) as outlined in Section 52 of the Transfer of Property Act. It explains that during the pendency of any suit or proceeding in which any right to immovable property is directly and specifically in question, the property cannot be transferred or otherwise dealt with by any party so as to affect the rights of any other party thereto under any decree or order which may be made therein.

Topic 10: Fraudulent Transfer and Doctrine of Part Performance

This topic covers two important doctrines under the Act. 'Fraudulent Transfer' (Section 53) deals with transfers made with the intent to defeat or delay the creditors or subsequent transferees. The 'Doctrine of Part Performance' (Section 53A) provides protection to a transferee who has taken possession of immovable property in part performance of a contract for transfer, even if the transfer deed is not registered, subject to certain conditions.

Topic 11: Law of Succession (Indian Succession Act, 1925)

While TPA deals with inter vivos transfers, this topic introduces the Law of Succession, primarily governed by the Indian Succession Act, 1925 (for Christians, Parsis, Jews, and others) and personal laws for Hindus and Muslims. It covers concepts like testate succession (under a Will) and intestate succession (without a Will), discussing the distribution of property after the death of the owner.

Topic 12: Law of Trusts (Indian Trusts Act, 1882)

This topic introduces the Law of Trusts as per the Indian Trusts Act, 1882. A 'Trust' is an obligation annexed to the ownership of property, and arising out of a confidence reposed in and accepted by the owner (trustee), for the benefit of another (beneficiary), or of another and the owner. It covers the creation, duties and liabilities of trustees, and rights and liabilities of beneficiaries.

This topic examines how the Specific Relief Act, 1963, provides remedies related to property rights. It covers provisions allowing for the recovery of possession of immovable property, specific performance of contracts involving property, injunctions to prevent interference with property rights, and cancellation or rectification of instruments related to property.

The Indian Stamp Act, 1899, requires stamping of certain documents to make them legally admissible as evidence, including those related to property transfers.
